Jerry Brown - Debates Continue

As the Saying Goes, the Majority Should NEVER vote on Rights for the Minority.

Atty. Gen. Jerry Brown's reversal on Proposition 8 -- he now is asking the California Supreme Court to reject it -- is the talk of the blog world today. Of course, the pro-gay-marriage forces are happy. But there is a lot of debate about whether Brown's rejection of the voters' will on gay marriage can fly. Jonathan Turley writes:

Brown's position between the earlier and current litigation seems hopelessly conflicted. It would have been more consistent if he refused to defend either the earlier law or current law. Yet, there is the problem of lawyers defending a law that they consider to be unconstitutional. Brown can argue that, once the Court recognize the constitutional right of same-sex couples in the Constitution, it became a problem to have it set aside by popular vote. The earlier law was the result of legislative consensus while this is the product of popular vote.

Yet, there status as "law" is the same for the purposes of the Attorney General's office.

Red County California sees a political motive in Brown's stance:

Jerry Brown, as the California State Attorney General, said that he would defend Proposition 8 if it passed. He is now asking those same black-robed dictators to declare Proposition 8 unconstitutional. Heck of a democratic state we live in, when an attorney general with an eye on the next gubernatorial race will pander to an activist voting bloc to thwart the democratic process dutifully followed by a majority of citizens to express their will multiple times and in multiple ways.

Why Marriage Matters

..."Wolfson articulates the pioneering arguments that have made him one of the nation's most influential gay activists."— LA Times Book Review

"Armed with Wolfson's arguments, you could sell anyone with an IQ over room temperature on the wisdom and humanity of marriage equality."— The Oregonian

"...thoughtful, reasonable, and eminently worthy..."— Kirkus Reviews

"Perhaps the most important gay-marriage primer ever written... [A] cogent and moving argument."— Time Out New York

Civil rights attorney Evan Wolfson has been on the front lines in the battle for the freedom to marry for the past twenty years. In his book, WHY MARRIAGE MATTERS: America, Equality, and Gay People's Right to Marry (Simon & Schuster; June 2, 2005; $13.00 paper), with a new foreword by the author, Wolfson presents a compelling case for ending discrimination in marriage. ..........

Early Polls Show California's Prop 8 Gaining
Early poll results Tuesday night showed California voters leaning toward overturning same-sex marriage in the state in a decision that could impact how the issue plays out elsewhere in the nation. Approval of Proposition 8 would be a stunning upset in a $70-million campaign that just weeks ago looked to be running in favor of preserving gay marriage rights.
By 9 p.m. in California, 54.5 % of voters favored passing Prop 8, as the measure is known, and 45.5% were against it, with 20.9% of precincts voting, according to the Secretary of State. However, both sides cautioned that the vote could be very close and that it might still be early to declare a winner. The passage of Prop 8, as it is known, would be a major victory for religious conservatives seeking to ban gay marriage in other states, and a crippling setback for the gay rights movement nationwide.

Queen Latifah Marriage ?

After the state of California overturned a ban on gay marriages, many expected a rash of same-sex marriages to be scheduled in the state. On the celeb side of things, it seems that Queen Latifah will be amongst the first big stars to marry her longterm partner.

According to this week's edition of the National Enquirer, Queen Latifah plans to marry her partner of five years, personal trainer Jeannette Jenkins.
Queen Latifah has been very tight-lipped about her relationship with Jenkins, and told Ebony magazine in 2007 that she would not comment on the rumor that Jenkins was her girlfriend. She didn't deny it, she was just annoyed that she was asked.

“No comment on that at all. I’m done commenting on all that … It’s ridiculous, I know me and that’s all I need to know.

“And if the readers don’t know me, then that’s one part they aren’t going to get to know. Those are my people but they don’t sleep with me,” she says in a very even tone that is very consistent with her relaxed mood. “It feels so invasive. It’s the one thing I don’t think people need to know about.”
